Failure to diagnose a neurofibroma claim settled for £18,000 - Written by Freya Johnson, Trainee Solicitor

Clear Law were happy to bring a longstanding claim for a delay in diagnosis to a successful conclusion for the Claimant.

The Claimant, received £18,000.00 as a result of the Defendant’s misdiagnosing him as suffering an inguinal hernia when the mass was actually a neurofibroma and perforation of a major artery resulting in 2 emergency procedures.

The Claimant had been diagnosed with neurofibromatosis in 1999 but has not previously experienced any symptoms nor received any treatment for this; he was only tested for this when his daughter was diagnosed with the condition. 

In 2016, the Claimant developed a lump in his groin which was painful. He was advised this was a hernia and was listed for surgery on 20th June 2016. He underwent surgery during which time a biopsy was taken of the lump. Mesh was inserted during this procedure. The Claimant was discharged the same day.  

On 21st June 2016 the Claimant woke up in severe pain and telephoned an ambulance. The Claimant suffered a cardiac arrest following his re-admission into hospital. He was subsequently diagnosed with a severed blood vessel in his groin area which was causing internal bleeding; he lost excessive amounts of blood. He was taken to theatre to stop the bleeding and subsequently he was admitted into ICU.  The Claimant was admitted into hospital for over 2 weeks.

Following his discharge, the Claimant has continued to experience nerve damage in his leg which impacts on his mobility. The Claimant's unable to walk as far as he used. In addition, the Claimant has experienced depression and has been referred for Counselling due to his condition.

The Defendant then on the 20/06/16 attempted a left inguinal hernia repair, which caused direct damage to a major artery, resulting in 2 emergency procedures. The claimant will say that the Defendant should have considered an alternative diagnosis in light of the Claimants neurofibromatosis and referred him on for specialist opinion. The Defendant should not have a attempted a hernia repair and should not have carried out an open biopsy of the tissue, at a time when they could see they were not dealing with a hernia. The Defendant’s negligence caused the Claimant to suffer perforation of a major artery, emergency admission to Hospital, bilateral pulmonary embolus and a prolonged stay in Hospital. The Claimant now suffers with Post Traumatic Stress Disorder.

The Defendants put forward an offer to settle of £15,000.00 on the 01/03/2022 to which the Claimant then provided a counteroffer of £18,000.00 to which this was accepted on the 04/03/2022.
